Thank you for visiting this website. Protecting your personal data matters to us. Below we inform you, in accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR), about which data is processed when you visit this website.

2. Visiting the website and access data

This website is hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. When you access the website, your browser transmits technically necessary data which Vercel processes on our behalf:

  • IP address of the requesting device
  • date and time of access
  • name and URL of the requested file
  • amount of data transferred and notification of whether the request succeeded
  • browser type, browser version and operating system
  • previously visited page (referrer), if your browser transmits it

This processing is necessary to deliver the website, ensure its stability and security and fend off attacks. The legal basis is our legitimate interest under Art. 6(1)(f) GDPR. This data is not merged with other data sources and is not analysed for advertising purposes. We do not keep log files ourselves; Vercel retains the access data only briefly and deletes it according to its own retention periods.

The website is delivered through Vercel's global content delivery network. Requests from Europe are usually answered from European locations, but processing in the USA cannot be ruled out. According to its own statement, Vercel Inc. is certified under the EU-U.S. Data Privacy Framework; in addition, the European Commission's standard contractual clauses apply (Implementing Decision (EU) 2021/914). Appropriate safeguards for the transfer to a third country under Art. 44 et seq. GDPR are therefore in place.

A data processing agreement with Vercel in accordance with Art. 28 GDPR is in place; it forms part of Vercel's terms of service.

3. No cookies, no tracking

This website sets no cookies and uses no analytics, tracking or advertising services. No audience measurement takes place, no usage profiles are created, and no social media plugins, ad networks or chat services are embedded. That is also why there is no cookie banner: there is simply nothing to consent to.

The website only stores technically necessary information as part of a normal page request. It does not access storage on your device, such as local storage.

4. Fonts and images

All fonts (Alfa Slab One, Karla) and all images on this website are served together with the website itself. No connection is made to Google Fonts or any other external server, and no IP address is transmitted to third parties.

5. Contacting us by email or phone

If you contact us by email or phone, we process the data you provide (for example your name, email address, phone number and the content of your enquiry) in order to handle your request. This website does not offer a contact form.

The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to entering into or performing a contract (for example a table booking or an artist application), and otherwise Art. 6(1)(f) GDPR based on our legitimate interest in answering enquiries.

We delete this data as soon as it is no longer required for the purpose for which it was collected and no statutory retention periods apply. Commercial and tax law may require storage for up to ten years.

6. Bookings and external links

Table bookings run through our separate booking system at reservas.oktoberfest-mallorca.eu. When you click the booking button you leave this website. The privacy policy published on the booking site applies to data processing there.

The same applies to the links to our Instagram and Facebook profiles (Meta Platforms Ireland Ltd., Dublin, Ireland). These profiles are only linked, not embedded: data is transmitted to the respective provider only once you click one of those links. We have no influence over that processing.

7. Encryption

This website is delivered via HTTPS (SSL/TLS). Data transmitted between your browser and our server is therefore protected against being read by third parties. You can recognise an encrypted connection by the padlock symbol in your browser's address bar.

8. Your rights

With regard to your personal data you have the following rights against us at any time:

  • right of access (Art. 15 GDPR)
  • right to rectification (Art. 16 GDPR)
  • right to erasure (Art. 17 GDPR)
  • right to restriction of processing (Art. 18 GDPR)
  • right to data portability (Art. 20 GDPR)
  • right to object to processing (Art. 21 GDPR)
  • right to withdraw consent at any time with effect for the future (Art. 7(3) GDPR)

An informal message to info@oktoberfest-mallorca.eu is enough to exercise them.

Right to object: where we process data on the basis of Art. 6(1)(f) GDPR, you may object to that processing on grounds relating to your particular situation. We will then no longer process the data unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms.

9. Right to lodge a complaint with a supervisory authority

Without prejudice to any other remedy, you have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your data infringes the GDPR. As our registered office is in Spain, the competent authority is:

10. Changes to this privacy policy

We will update this privacy policy whenever the legal situation or the processing on this website changes – for example if we add a contact form or a map in the future.
